The 42 year old defendant, Chen Mou, from Putian, Fujian Province, is the actual responsible person of the defendant unit J * * trading company. According to the court's hearing, since 2017, Chen knew that the smelting residues of iron and steel plants purchased by the company from abroad were solid wastes prohibited by the state, and still decided to purchase smelting residues in Thailand and other places with J * * trading company as the consignor and consumer unit, and then falsely reported the import to the customs four times under the false name of zinc oxide mixture.

After the incident, J * * trading company smuggled two batches of solid waste into Xiamen port, totaling about 533 tons, which were ordered to be returned to China last year. The company declared to Putian customs for import of 22 containers, a total of more than 470 tons of solid waste, has also been seized.

Xiamen intermediate court held that J * * trading company, the defendant, violated customs regulations and evaded customs supervision and imported solid waste prohibited by China through false name declaration. As the direct responsible person of the defendant unit, the defendant Chen constitutes the crime of smuggling waste.

In the first instance, the court fined the trading company 650000 yuan, and the defendant Chen was sentenced to three years and six months with a fine of 100000 yuan.

Since last year, the customs of China has blocked the smuggling of foreign garbage into the country. 783 cases have been put on record, 1044 suspect suspects have been arrested, and 2 million 209 thousand and 800 tons of foreign garbage, including smuggled plastic waste, waste slag and scrap hardware, have been verified.

In the area where a large amount of garbage is piled up in the open air, the odor is high, the rats are in a disaster, mosquitoes and flies breed, and a large number of pollutants such as ammonia and sulfide are released into the atmosphere. In the powder coal and tailing yard, in case of strong wind above grade 4, the dust can fly 20-50 meters, and the surface can be peeled off 1-1.5 cm, causing air pollution.

3. Serious water pollution. The hazardous and toxic substances contained in arbitrarily stacked or simply landfilled garbage can seriously pollute surface water and groundwater, resulting in frequent environmental pollution incidents.

4. Garbage explosion, spontaneous combustion and other accidents occur constantly. Due to simple stacking, it is easy to cause explosion, spontaneous combustion and collapse. Debris flow and other accidents cause losses to people's lives and property.

However, the harm of solid waste to the environment and human beings has aroused great attention. We should fully understand and evaluate the universality and complexity of the harm of solid waste, and do a good job in the prevention and control of solid waste pollution in accordance with the law, so as to make it serve human beings.
